  • to fulfill a legal obligation which requires processing under the law of the Union or the Member States to which KLAEGER is subject, or to perform a task which is in the public interest or in the exercise of official authority and which has been assigned to KLAEGER ;

  • for reasons of public interest in the field of public health in accordance with Art. 9 para. 2 lit . . h and i and Article 9 3 DS. – GMOs;

  • for archiving purposes in the public interest, scientific or historical research purposes or for statistical purposes acc. Art. 89 para 1 DS. – GMOs if makes the extinction law is expected to achieve the objectives of this processing impossible or seriously impaired, or

  • to assert, exercise or defend legal claims.

  1. Right to be informed

If you have asserted the right to correction, deletion or restriction of processing against KLAEGER , KLAEGER is obliged to inform all recipients to whom your personal data have been disclosed of this correction or deletion of the data or restriction of processing, unless this is the case proves to be impossible or involves a disproportionate effort.

You have the right vis- à- vis KLAEGER to be informed about these recipients.

  1. Right to data portability

  1. You have the right to receive the personal data that you have provided to KLAEGER in a structured, common and machine-readable format. You also have the right to transfer this data to another controller without hindrance from the controller to whom the personal data has been provided, provided that

  • processing based on consent in accordance with Art. 6 para. 1 lit . a DS – . GMOs or Art . 9 para 2 lit . a DS – GMOs or pursuant to a contract. Art. 6 para. 1 lit . b DS – GMO based and         

  • processing is carried out using automated processes.

  1. In exercising this right, you also have the right to have your personal data transmitted directly from KLAEGER to another person responsible, insofar as this is technically feasible. The freedoms and rights of other people must not be affected by this.

  2. The right to data portability does not apply to the processing of personal data that is necessary for the performance of a task that is in the public interest or in the exercise of official authority that was transferred to KLAEGER .

  1. Right to object

  1. You have the right at any time for reasons arising from their particular situation to the processing of personal data concerning the basis of Art. 6 para. 1 lit . e or f DS – GVO takes place to object; this also applies to profiling based on these provisions .

  2. KLAEGER no longer processes your personal data unless KLAEGER can demonstrate compelling legitimate grounds for the processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

  3. If the personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is connected to such direct advertising

  1. If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes.

  1. Regardless of Directive 2002/58 / EC, you have the option of exercising your right to object in connection with the use of information society services using automated procedures that use technical specifications.

  1. Right to withdraw the data protection declaration of consent

You have the right to withdraw your data protection declaration of consent from KLAEGER at any time . Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.             

  1. Automated decision in individual cases including profiling

  1. You have the right not to be subject to a decision based solely on automated processing – including profiling – which has legal effect on you or similarly significantly affects you. This does not apply when making the decision

  • is necessary for the conclusion or performance of a contract between you and the person responsible,
  • is permissible on the basis of legal provisions of the Union or the member states to which the person responsible is subject and these legal provisions contain appropriate measures to safeguard your rights and freedoms as well as your legitimate interests or
  • with your express consent.
  1. However, these decisions must not personal to particular categories data pursuant to Art. 9 para. 1 DS – GMO based, not unless Art. 9 para. 2 lit . a or g DS – GMOs applies and adequate measures to protect the rights and freedoms, and your vital interests were made.     

  1. With regard to the cases mentioned in (1) and (3), KLAEGER takes appropriate measures to safeguard your rights and freedoms as well as your legitimate interests, including at least the right to obtain intervention from a person on the part of KLAEGER , to state your own position and to contest heard the decision.

  1. right of appeal

  1. Notwithstanding an otherwise administrative or legal proceedings, you have the right to appeal to a regulatory authority, the special in the Member State I hres residence, I hres job or the location of the alleged violation to if you are of the opinion that the processing concerned you personal data from the DS – violates GMOs.
